Terms of Sales
Any purchase or order made in EL photographer wins full acceptance of these terms and conditions.
ARTICLE 1 - COPYRIGHT
EL photographer not confer any all copyright.
1.1 - MORAL RIGHTS
Photographer enjoyed the right to respect for his name, his quality and his work. This right is perpetual, inalienable and imprescriptible. (Articles L.121-1 to L.121-9 of the Code of Intellectual Property).
1.2 - Economic Rights
The right of exploitation belonging to the photographer has the right to representation and the right of reproduction. (Articles L.121-1 to L.122-12 of the Code of Intellectual Property).
The photographs made by my care, distributed and sold via my web site are for personal use. Copyrights are governed by the Code of intellectual property by the laws of 11 March 1957 and 3 July 1985. ARTICLE 2 - ORDERS
The placing of an order by the customer carries unconditional acceptance to these terms of sale, unless special conditions granted in writing by the photographer to the customer. Any other document that these GTC including catalogs, brochures, advertisements, notices, is merely informative and indicative, non-contractual. These Terms form an indivisible contractual document with the order and / or order online via the website.
All orders must be ratified by a good signed by the client or his authorized representative. Specified on the order form: datede the performance of the service, schedules, or places, the price and the down payments. Any quotation signed by the parties takes the place of purchase order.
ARTICLE 3 - TARIFFS
The prices of our products are indicated in euros all taxes included, excluding postage and packaging costs. Those will amount to £ 4 Euros for all orders delivered in France (including Corsica).
EL photographer it reserves the right to change prices at any time. The products are invoiced on the basis of tariff in force at the time of registration of the order.
ARTICLE 4 - PAYMENT ACCEPTED
For the settlement reports, will be asked 50% on order and the balance must be paid 2 weeks before the date of the latter, by transfer or check payable to EL photographer.
To order photos on site or via the websites: www.ericlahurtephotographe.com or www.ericlahurtephotographemariage.com, payment is made to order, the accepted means of payment are checks, credit cards and bank transfer.
For photos and CD-ROM purchased on the location of the event, the means of payment accepted are cash and checks.
Photographer EL reserves the right to refuse payment from a foreign country, not a member of the European Economic Community, or due to technical difficulties, particularly with regard to checks drawn on foreign accounts or transactions from foreign countries can lead to significant bank charges and exchange fees.
ARTICLE 5 - COMMAND CHANGE
Any order is irrevocable by the customer, unless otherwise expressly acceptance of the photographer.
Any request for modification of an order placed by a customer will be taken into account, if the request is made in writing, including, fax or email and came to the photographer at the latest 7 days after receipt of the initial order or at the latest one month before the expected date of delivery.
The cancellation of the contract by married a week before delivery, the balance will not be refunded.
The installments paid by the customer will not be refunded. In case of modification of the order by the customer, the photographer will be loosed agreed deadlines for its implementation.
ARTICLE 6 - DELIVERY REALIZATION
The photographs are taken by EL photographer or other designated by the photographer.
ARTICLE 7 - CUSTOMER REQUIREMENTS
When making photographic service, the customer agrees to comply with the instructions of the photographer and include:
- The professional will not be embarrassed in the delivery by amateur photographers.
- Portraits of married will be performed in their presence, to the exclusion of any third party without express agreement of the photographer.
- Prior approval of the priest must be obtained in case of photographs taken during the Mass. In case of default of compliance with these instructions, the photographer can not be held responsible for the bad performance of the service.
- For all packages up the cake, a meal will be provided to the photographers covering or marriage.
- Mouth costs to the customer (2 + photographers cameraman if selected video package)
- Beyond 5 changes of BAT by married, other changes will be billed at the rate of £ 40 / modifications.
- Any picture on any carrier will be sent to the signatories of the contract as well as family members or friends before the HD DVD constitution sent together with the album.
- Any request for sending priority and validated by the photographer will be charged 5 euros per photo.
- The customer agrees not to disseminate among the various wedding service providers (hair stylist, makeup artist, caterer, etc ...), the images without prior permission of the photographer.
ARTICLE 8 - FORCE MAJEURE
In case of force majeure (bad weather, bad weather, storms, storms, etc.) the photographer reserves the right to change the terms of performance of the service provided on the order form (locations, times, days ...). In case of major changes, the photographer reserves the right to modify the proposed rates.
ARTICLE 9 - DELIVERY
The work can be shipped to the declared value at the customer's request and expense, after full payment of the invoice will include the said charge. (Also valid for online orders). Professional is committed to providing the customer within the time specified on the order. Uploading pictures in personal gallery within 15 days maximum after the wedding. All elements of the package (Album, DVD, etc ...) are delivered in only 1 time in maximum 1 month (21 working days) after validation of the BAT (Good to draw), no separate shipments.
Any delay in the implementation of the provision may lead to compensation equal to the prejudice justified by the customer, except in cases of force majeure or delay due to the fault of the customer. If sent by mail, the photographer is not responsible for any delays that may occur in the delivery of mail.
ARTICLE 10 - COMPLAINTS
In case of improper development or default, the client must inform in writing the photographer within 7 days of receipt of the photographs. Otherwise, after this period, the customer will be deemed to have accepted the photographs in the state.
ARTICLE 11 - WITHDRAWAL OF PAPER PHOTO
The delivery of photo paper on prints ordered by printed order form on the website or www.elweddingphotographer.co.uk place in a maximum period of 15 working days, subject to disruption due to the postal network and reception your order. The customer is responsible for the address provided. No claims will be accepted if the address provided is incorrect or incomplete.
ARTICLE 12 - BILLS
Any invoice for your purchases by EL photographer will be obtained upon delivery of your order. EL photographer is subject to the system of VAT not applicable, art. 293B of the General Tax Code
ARTICLE 13 - DATA PROTECTION
13.1 - ACCESS TO YOUR PERSONAL DATA
Under the Data Protection Act of 6 January 1978, you have a right to access and rectify any photos of you.
13.2 - LIMITATION OF LIABILITY
Despite the care taken on the prudence and diligence to ensure the safety and protect the confidentiality of the pictures published on its website, photographer EL disclaims all liability for any attempted burglary, hacking or acts of malice committed on the network and target computer facilities related to providing the service despite the precautions taken, and about the adverse effects that may result.

ARTICLE 14 - INTELLECTUAL PROPERTY
Photographs are property of the photographer. Any use of a photograph, whatever it is and what are the uses: distribution, exhibition, ... reproduction, made without the prior written consent of the photographer is an offense against way. If agreed the photographer it leads to an agreement that includes the payment of user fees. The customer will be liable for any violation of this prohibition.
ARTICLE 15 - SHELF LIFE OF PHOTOGRAPHS AND VIDEOS
Photographer agrees to keep the original documents at the disposal of his client during a period of 2 years. Any proofing or duplicate must be ordered the photographer.
All the elements of realization of the videos (rushes) will be removed from the databases within 1 month after the delivery of the DVD or the USB key.
ARTICLE 15.1 - DATE OF MANUFACTURE LIMITED
Deadline for making the album and packages component elements, the deadline is one year after the posting of photos on the private gallery. After the expiry of the period EL photographer will not be required to conduct manufacturing.
ARTICLE 16 - LOSS AND DAMAGE OF PHOTOGRAPHS
The loss or deterioration of photographic work and negative results in compensation equal to the price of such work billed by the professional on the declared value when ordering.
Any technical incident can not under any circumstances give right to compensation. In case of loss of the videos by a technical or material failure, no compensation can be claimed and no lawsuit can be brought against the videographer.

ARTICLE 18 - DISPUTE RESOLUTION
Any dispute concerning the validity, interpretation or execution of the contract and after failure of any amicable conciliation will be submitted to the courts of Nanterre.
The Parties undertake, before any legal action, to submit their differences to the mediator appointed by the representative bodies of professional photographers. Any questions regarding these terms and conditions of sale are governed by French law.
ARTICLE 19 - CHANGES IN GENERAL CONDITIONS OF SALE
Photographer EL reserves the right to proceed at any time, without notice, to change these general conditions of sale.

These conditions of sale can be modified, the applicable conditions are those in effect on the website at the time of placing your order.
